United States ex rel. McCoyd v. Abbott Laboratories (W.D. Virginia)
Ann Lugbill served as one of the original lawyers for Georgia Relator McCoyd, prior to joining the Murphy Anderson law firm. Ann was part of a team of lawyers who prepared the complaint and met with the Government during its civil and criminal investigation. The case alleged that Abbott widely marketed its anti-seizure drug, Depakote, indicated only for epilepsy, to nursing homes and physicians for uses not within the approved FDA label. As the Department of Justice Press release reports: "Abbott has pleaded guilty to misbranding Depakote by promoting the drug to control agitation and aggression in elderly dementia patients and to treat schizophrenia when neither of these uses was FDA approved." The case settled in 2012 for $ 1.5 billion, which included $ 700 million in criminal fines and penalties.
